Genneva Gold

Someone sent me a question to ask me about Genneva Gold Sdn Bhd.

According to the information on the website, Genneva Gold sells you Gold Bullion at a 2% discount to the market price with a buy-back guarantee.

At the end of one month, the buyer can

  1. Sell buy the gold to Genneva Gold at the market price based on the time he bought (thus making an immediate 2% profit)
  2. Keep the Gold Bullion.
  3. Rollover. Meaning do step one and buy a new Gold Bullion at a 2% discount to the current market price.

The deal seems too good to be true because the company is essentially selling you gold at a 2% discount and giving you a free put option.

There doesn’t seem to be any downside for the investor. If the price of gold goes down, he can sell it back to the company. If the price of gold goes up, he can keep the gold and sell it on a secondary market by himself.

Anyone considering this investment should ask important questions like:

  1. How does Genneva Gold generate revenue/profit from this entire transaction?
  2. Assuming an investor does just the bare minimum and rollovers his investment for 12 months, he would have made a 24% return. How does Genneva Gold substain this payout?
  3. How do you verify that the gold you receive is worth its weight in gold?

There is a “Terms and Conditions” to the 2% discount thing though. I would be interested to know what they are.

Aiyah, you don’t know ah uncle, Dato’ K is with them lah. When The good Dato’ was with the raided goldco, we also did not touch them, right? Even the name has a “guarantee” in it and the good Dato’ K won’t go for any hanky panky, would he? That pl and cow thought they are damn smart, can play play with Dato’ K and get away with it. We the rakyat, as law abiding citizen, hear you all loud and clear and would like to point out to you upper class society that Malaysia subscribe to the rule of law. Every individual or company has a right to run its own lawful business without interference from the the authorities and when such interference occur, resulting in business interruptions, and losses to the company concerned, it can file its affidavits supporting its case and seek redress from the courts, be it a restraining order or an injunction to cease and desist from interference in its business and claim compensation for the losses incurred as a result of such interference. Why are you all not doing this but keep running to canvass the PM, the BNM governor and the home minister for support. The governor would look damn stupid if she were to accede to your demands after her team raided you and suspended your business activities. That would expose BNM to huge claims for compensation from you all and a loss of credibility. Don’t you think so? The home minister would also look damn stupid if he were to tell PDRM to back off since it will send a signal down the line that his remote controller doesn’t work or he does not have a clue as to what is happening in the home ministry. The PM cum finance minister likewise would lose his credibility if he were to instruct the finance ministry to instruct all the 4 (BNM, SSM, PDRM & Consumer affairs)to back off even though his late cousin was your illustrate chairman with capabilty far exceeding that of Dato’ K.
So, for the sake of the customers, please instruct your clever lawyer who advises you on all the manouvres to stay within the law, to seek redress from the court. Remember, it is already more than 3 weeks from the date of the raid and the customers are really hard pressed and as you may already been aware, desparate people do desparate things, if they find that their grievances are not being addressed especially those who had borrowed to buy the gold but for which you have as yet not delivered a single gram, or those who had gone to borrowed using their gold as collateral in order to do a few rounds. As for the consultants, you rent seekers are simply pathetic groveling and sucking up to the mega rent seekers in ameno after being rebuffed by the mca.
To help you all, BNM had prepared a set of answers to FAQs and the grounds on which it based its raid. With all the clues and a superb/clever lawyer, you cannot fail or can you?

Bank Negara: FAQs on gold firm raids

PETALING JAYA: Bank Negara has provided answers to nine frequently asked questions following raids against companies suspected of operating illegal financial schemes using gold.

On the authorities’ concern with the business model of such companies, Bank Negara said the operating schemes were believed to be unsustainable.

“Such schemes are not funded through actual gold trading but from new monies invested into such schemes,” it said.

It also added that the value of assets and monies held by such companies did not commensurate with the amount collected from the investors.

> On why the raids were carried out:

The companies were being investigated for suspected offences, including illegal financial schemes, money laundering, tax evasion, false description including misrepresentations, appointment of agents without licence and failure to lodge statutory documents.

> On why the authorities were only taking action now:

Enforcement action can only be taken when it has been established that there is reason to believe an offence has been committed.

“This is to avoid hasty or reckless enforcement actions that may affect genuine businesses,” said Bank Negara, adding that the length of investigations depended on the complexity and magnitude of the case.

It also said that the investigations were accorded high priority and all necessary resources were being mobilised by the relevant enforcement agencies to conclude the investigations as early as possible.

> On why the assets of the affected companies were frozen and seized:

This is to prevent attempts to destroy or suppress evidence.

“This also prevents the assets from being dissipated to the detriment of the investors,” said Bank Negara.

> On whether the affected investors can claim their money or gold from the seized assets:

Bank Negara said it was up to the court.

“After the court proceeding is concluded, investors may file to the Court a third party claim for the return of money or gold,” it added.

Bank Negara also provided tips to evaluate an investment scheme such as urging consumers to only deal with licensed financial institutions and authorised dealers as well as refer to financial fraud alert on Bank Negara and Security Commission’s websites.

    BNM asked to refer to the alert list, TGG Malaysia Sdn Bhd is not in the list, does that means this gold company is legalised by BNM? Of its not then what reason they are being left out, if they are then based on what account that they can be legal in the eyes of BNM?

Q: Why have the assets been frozen and seized?

A: In cases of suspected illegal financial schemes, the authorities conduct search and seizure operations to secure the evidence and to avoid the companies from destroying or suppressing evidence. This also prevents the assets from being dissipated to the detriment of the investors.

Under section 44 of Anti-Money Laundering and Anti-Terrorism Financing Act 2001 (AMLATFA), the law enforcement agencies are empowered to freeze any assets when it is suspected that an offence of money laundering has been committed.

Q: What is going to happen to the assets and gold that have been seized?

A: Any assets seized during the course of raids are meticulously documented and accounted for and maintained in safe custody. If there are criminal proceedings, such assets will only be dealt with at the direction of the Court.

Q: Can an affected investor claim his/her money or gold from the seized assets?

A: Assets seized during the course of the investigations can only be dealt with at the direction of the Court. Investors may file to the Court a third party claim for the return of his/her money or gold. Information on whether, and how, to file a claim will be provided after court proceedings are concluded.

I remember in August when BNM issued public warning of Ponzi gold trading as well as alert list, Anon List has this to say repeatedly:

1. Is it stated on BNM PONZI warning advert the name of GM2, Poh Kwong, or any banks? Do BNM PONZI warning advert make reference to the alert list?

Sg CAD issued their FAQ followed by BNM on 22/10/2012. Must admit that BNM has a more complicated case compared to CAD. Despite the twist by the con-sultans, please note the following :
1. The Joint statement is issued by BNM jointly with the RMP (PDRM or as some call it PRDM – Polis Raja Di Malaysia), Ministry of Domestic Trade, Cooperative and Consumerism and SSM or Companies Commission of Malaysia.
2. The earlier stated subjects of investigation is repeated, viz.,
“suspected offences that include illegal financial schemes, money laundering, tax evasion, false description including misrepresentations, appointment of agents without licence and failure to lodge statutory documents. The statement can be viewed at the BNM website.
As proposed earlier, either BNM or the goldco should hold a gathering and explain their positions to those affected instead of all the fat arses in the “Genneva support group” going around dangling false hopes to those affected. The situation is further complicated by Dato’ K switching camp after being ousted by the PM’s cousin. Genneva won the battle but the war is now fought on the BNM turf. Watch for developments as history repeats itself with some variations in the plot of the sequel.

Well, do we need proof? Intelligent readers can infer the similar writing type, similar arguments, similar words and decide whether the posts originated from the same person. JH has already highlighted in Bold the various KEY words for inference.

Anon Me is as usual using semantics and wordplay to dodge and deflect.

Now Anon Me said whether GM2 is ethical depends on the results of the investigation by BNM and other enforcement agencies. So GM2 was not in control of its operations right from the beginning, the directors are “unsure” if they were ethical because as per Anon Me – “It is ethical up till point of investigation. Thereafter, it hinges on the results”.

An “Anonymous” drug pusher sells drugs to addicts, saying “YOUR MONEY, YOUR CHOICE, YOUR HEALTH, YOUR RISK” and claims he is doing ethical biz. When caught, he still claims he is ethical, pending investigation results. So, this Anonymous’s drug pusher’s biz is ethical if uncaught, and unethical if sentenced?

Does laughing at others ease your pain and agony. Like all rent seekers, you are arrogant, full of sound and fury signifying nothing. Hi, this is Uncle Martin’s blog and it is not for you to welcome or not welcome anyone. 1. The goldco has no more money to splash around. The PM is saying “don’t worry” We will get our funds elsewhere for GE-13. Your princess came to see me empty handed not even some buah tangan for my darling such as a Birkin handbag and she is not even convinced that your business model is sustainable. Moreover, her uncle is in Royal G and is a fan of mine not like you and your buddies who only want to use me;
2. The goldco is not interested in positive BNM action such as return of seized items and unfreezing of their accounts as they will then have to face the wrath of the customers if they do not deliver;
3. The goldco has a lot of shit which will hit the fan once they go on the rabble rousing;
4. The goldco waited nearly a year before taking action re- Genneva Sg and now when the letters are on the wall, the trio of NPW, Marcus or was it Sunny, and CWL are abandoning the Pte Ltd knowing it is a gone case and blaming it on their Sg partner LWK for their negligence of fiduciary duty. Why didn’t the Sg con-sultans organize protest of the CAD action? Why didn’t they challenge the Sg DPM for the reported statement to Parliament?
5. The goldco trio is now scared stiff of being kidnap victims or being “hantam” by desparate customers. Here, I think the con-sultans will have to be carefull as there are instances where they have made mis-representations to get their customers business and if they do not get their masters to come out and sort out the mess they will be the next targets of the customers.
Happy gold buying but made sure that it is not ponzi using the same business model as the raided goldco

This is how a billion RM company known as Genneva is run – Directors all keeping quiet at the sight of trouble at their company.

En. Mohd. Sani, a Genneva Consultant:

They say we must support Genneva, …. so we did. But They should lead the way, and we can take the role of supporters. But in the end the consultants is leading the activity. Where are they the management people?

My customer is not happy where only the consultants are taking the initiatives in dealing with crisis but not the ma…nagement. Management seems to be happily ‘Lepas Tangan’ even they refuse to give assurance letter to the customer. Management thus far fails to do their part.

Consultants have no jurisdiction and authority to do anything. Only Genneva management has the authority. All meetings mostly organize by consultant. Where is the management? So all the meetings are fake and have ‘no standing’ (no minutes and Note of confirmation of the meetings.

Whose business is this? The consultants? The customers ? The consultants does not owns it, neither the customer, so who owns it? why do consultant so busy as if it is their company, where are the directors that owned the company and they (directors & management) should lead the way. Why are they running away? Where are they, why there is nothing been done by the management? Why ‘menyorok’? Even they fail to make arrangement meeting between PM and the new chairman. All are kept silence,….. and silence is as good as an absence and absence is that you are not doing your job or you have some ulterior motives and agenda.

Everybody is at stake now. I feel something is going on between them……. why they are leaving us alone to run the campaign? God knows… as I’ve mentioned earlier, in the end we are the victim and they scot free and we lost everything … and they open a new business as per 2009, next year…..

And now we know that, election is coming. Mandate of BN is coming to an end, and once they are busy with their campaign they have no time (they will not entertain us and give priority on meeting their party leaders) for us or even to government official (thru my experience as government servant). UMNO and MCA final meeting is over…. Others (MIC and Gerakan) will follow soon….. once they dissolve parliament, nobody is in power, and they will distanced themselves away for many reasons.

Of course, there was this question mark deliberately thrown in for future trolling purposes by Anon Me – to remain non-committal as in:

Did I say “Do they have the gold…” or Did I say “They have the gold….”.

This is precisely the purpose of Anon Me’s questioning. Not to seek clarification / elaboration as so “elegantly” repeated. But to AVOID making a definitive stand, and the question mark(s) leaves behind avenues to fabricate different versions of “follow up replies” depending on which way the wind is blowing.

So now Anon Me will proclaim along this line – “Thank you for verifying I did not state they had the gold when they buy. I merely questioned for clarification / elaboration. Did you not see the question mark ?”

Was there, not there….. could be, could not be……….. same boat? different boat………guess? guess not………question marks, no question marks………. All semantics wordplay game Anon Me is playing here.

No one can tell the future to 100% accuracy, not even a fortune teller. So when posters here like pc wong etc said Genneva will collapse soon, based on observed signs and indications, Anon Me question rebutted with “Your conjecture? Got a date to go with it?”.

When Genneva did get raided, notice the date issue now becomes irrelevant to Anon Me, the attack now becomes “He/She only knows when it happens. Much like you & I”.

Of course we will know it 100% when it happened, as with GM2 now. But there are people like pc wong (Anon Me excluded) with foresight and analytical mind who can foresee things happening to a reasonable amount of accurary.

Notice how quickly Anon Me’s position shifted from worshipping GM2 as a ethical and legal company to now:

1) do you still find GM2 ethical?

Ans by Anon Me: With investigation currently pending conclusion, my opinion hinges on the results.

I wait eagerly to see how Anon Me can snake his/her way around the follow up qn by greenhorn:

Witness the arrogance of the “Dream on” and the questioning of Mohd Sani and his lawyer client’s intention as if the lawyer does not know his rights and the party responsible for his being stuck.
Take the case of Benny Madoff, did those affected sue the authorities or Madoff?
Several months before the raid, BNM already issued their warnings and published their alert list. All they will say is “see you in court” as they had not raided the customer but the goldco. Did any of the goldco or affected customer take cognisence of the warning. Instead Joseph Kow, the goldco Regional Manager, went on an expensive roadshow using Goldbeam members’ fund, waving letters supposedly from the PM and authorities and telling the world the self righteousness of the goldco. Both Sg and Mal raided the goldco on the same day and the super efficient Sg is yet to announce the results of their investigations. Can BNM or the PM work faster to save the quality lifesyles of the con-sultans and customer? While my sympathies are with the customers, I think the con-sultans and the goldco had it coming. Did the gomen or the authorities carrying out the raid give the greelight for the goldco to run such operation? Are they responsible for the lavish lifestyle of the con-sultans? If the goldco feels that they are right why do they not take out a writ against the authorities and get the court to insue an injunction instead of fighting a “guerrila proxy” war. All that the authorities need to do is to tell the proxies to tell their masters to fight their own war. They have caused enough havoc with their get rich quick scheme.

Ai-yah you all have to be aware that the Directors and hidden hands (Ex Poh Kong partner Ng PW, Yee & Chin) are so busy to avoid the kidnapping which happened after GM1 was raided on 21/07/2009 for reasons you may guess. The regional director of GM2, the Penang Dato’ cow, at one of the meetings with senior con-sultans, very proudly told the meeting that he told BNM that he does not know how the goldco gets its money to pay the commission, hibah and expenses. That may be the reason BNM latch to the idea of the unsustainability due to the evasive answer. Customers should make police reports, report to BNM and the securities commission and SSM if they have interest in the seized assets as otherwise they may be deemed to be in abetment of the scheme. Your con-sultans are only looking after their own interest in protecting their golden rice bowl and expensive lifestyle. You die that is your business.
Incidently, today the goldoc is calling all con-sultans for meeting most probably to sign a petition to the gomen/ameno calling for the lifting of the suspension, return of seized items and unfreezing of the accounts.

hahaha, Anon Me, you are so malu now that you beloved GM2 has collapsed? Getting so personal now trying to defend your GM2? relac lah, not the end of the world.

The biggest losers here are the pro-GM2 people like Anon Me ! I for one, is a hater. I have a FB account (see link below) for GM2 haters to target the Directors and the Con-Sultants, but not the victims.

It is Anon Me YOUR purely deluded CONJECTURE that I had lost lots to GM2. Hey, let me play the game too – Anon Me said I lost lots to GM2, you Anon Me got a figure to go with that? RM 1K? RM 1 million? No figure, any SnP or statement? Anon Me got a date when I bought stupid gold from GM2? No date to go along with that?

Anon Me has already lost everything to GM2 that is why sulking so much here, assuming others are losing control over anger and rage as much as Anon Me himself (or her)…….Loser…snicker.

Of course Anon Me wants me to shift my target to other goldcos ASAP, because Anon Me cannot bear to read all the shitty things abt Anon Me’s beloved GM2 that I am exposing to the whole world.

But I so happy now enjoying myself bashing GM2 now left right center and of course at the same time inflicting much shame, pain and anger on Anon Me.

Dear Nur,

I am not done yet with GM2 because I feel this blog provides the victims a real-time source of information as well as uncensored views regarding GM2’s operation.

The victims, besides getting views and updates on Genneva Malaysia Supporters FB (obviously biased and heavily censored by the Admin), may turn to this blog or LYN or elsewhere to read for themselves alternative information. They can then decide what action they would like to take against (or for) GM2.

At the same time, new gold trading firms are emerging and making their presence felt to fill the void left by GM2 (eg TGG), I think this blog provides useful information on this kind of gold ponzi scam to potential new buyers.

I agree with you TGG may be the next “Tai Kor” in Malaysia gold trading scene.

I think I will only stop when the Directors of GM2 are formally charged in court for criminal commercial crimes.

I wonder why these people think that the hibah is a god-send, so much so that livelihoods are dependent on it. Who had “brainwashed” them in the first place?

They still do not accept the fact that the hibah is discretionary, even after the unsigned statement issued by Genneva in its website few days back.

They assume life will go back to normal even after BNM unfreezes GM2’s account (unlikely) and allows it to continue it gold trading operation (also unlikely). Will it?

NO. IF GM2 resumes normal operation, there will be a massive queue for buyback. Does GM2 have the $$$ to “honour” the buyback (also discretionary)? No. Payments will be delayed or GM2 simply declare bankrupt.

IF GM2 resumes normal operation, unlikely they can get new buyers to buy their gold. Without new buyers, the musical chair game stops, no income to pay the hibah. No more OPM to pay the hibah.

So, the outcome for the victims are the same whether or not GM2 resumes operation – unlikely to get any money from GM2 in the next few years (either UNABLE to resume pending court case, or ABLE to resume but cash strapped).

The preferred scenario for the Directors is for its account to remain freezed and fight the case in court (as with GM1) which we are already know
will take many many years. With GM1’s case still pending and undecided, when will the turn for GM2? Meanwhile, it is still party time for the Directors, they are “innocent” till proven otherwise.

While the 2 court case drags (GM1 nd GM2), the Directors will start GM3 and suck in fresh buyers. The cycle repeats.

As for the victims of GM1 and GM2, the convenient excuse by the Directors is the fault lies with BNM and Ag Chambers, not them.

Time for victims of GM2 to wake up from their eternal hibah dream.

After 20 days of being caught in a predicament by Bank Negara’s raid on gold company Genneva, a brief meeting with Prime Minister Najib Abdul Razak yesterday brought some relief for some 60,000 customers with millions in savings in the precious metal.

Genneva Supporters Group spokesperson M.Shanti met Najib briefly before he entered PWTC for the Supreme Council meeting.

“We are very happy with prime minister’s reassurance, telling us not to worry,” said Shanti.

She then quoted Najib as saying: “I already know about you all and your Genneva case. We are working on it. Don’t worry, we are looking into it.”

Shanti also handed over an appeal letter to the PM stating that over 240,000 family members were dependent on the benefits from Genneva hibah and commissions.

The letter signed by Shanti read: “We use the hibah for medical expenses like operations, dialysis, children’s education fees and family’s expenses.

The whys for requesting help

“Taxes, loans, and even the economy of the country has received our support as we were able to make timely payments.

“For retired customers, aged 60 to 80, it was their live long savings which was bringing hope in the form of hibah (discretionary gift) based on the principles of Syariah.. Many of us are dependent on the hibah and commissions for our livelihood.”

Shanti said they wanted the government to unfreeze Genneva Malaysia assets and company account enabling it to fulfill its obligations to its customers.

At the same time she urged the government to regulate the gold trading industry in Malaysia.

Genneva’s customers were given false hopes by a hoax letter circulated stating that Genneva has been reopened and the customers could go to the office to collect their gold.

Millions of ringgit are now at stake following the raid and suspension of Genneva’s operations.

Todate, Shanti said: “Genneva has fulfilled its obligations to us as customers.

Some of these gold buyers date back to about three years ago when it opened for business at the end of 2010 launched by the former prime minister Dr Mahathir Mohamad, on 15th December 2010.”

Shanti called on the government to act swiftly and direct Bank Negara to allow Genneva to recommence operations and thereby safeguard and protect its 60,000 customers.

1. Pls advise where one may read clearly that Genneva model of business is the one targeted? Was it mentioned by name? As My central bank, do they frequently make insinuations or do they supposed to issue statements which are clear & without ambiguity?

2. If “illegal and fraudulent”, why are they allowed to continue operation? (utter refutation of rubbishy illegalities mentioned by p c wong)

3. How much longer will Bank Negara carry on giving out hints, warnings & advice before actual raids are actually launched? 1 week, 2 weeks, 1 month, 2 months?

4. If no raids happen after this span of time, may we conclude your above statement in capitals is nothing but more conjectures & imaginations of an unstable mind?

        So, let’s keep to the fact of situation here (i.e. the RAID DID HAPPEN) and not dwell on the wishful imagined situation (i.e. what if the raid never happen).

        My questions to you based on the fact that the raid DID happen, so: –

Post raid, goldco can claim that they cannot submit as all documents had been seized by the raiders remember the grandfather goldco which did the Park-In?

        3) And PC Wong added on 30/05/2012 at 09:54 (Page 13)
        Decline buyback :
        (a) GM2 makes only a pittance from the 25% mark-up after lessing out the hibah, the up and up commissions, and the admin costs.
        (b) Not only that, excess buyback over the rollover and new sales means GM2 will become stuck with huge gold inventory for which they have NO CAPITAL to hold, and which can only sell in open market at significant discount to spot price (is this tenable??)

        BNM raid :
        (a) All documents taken away, so cannot and no need to prove any account to buyers.
        (b) Tell all buyers to blame the BNM for messing up GM2′s fantastic business model.
        (c) Take money and any gold stock and run/hide before raid. Didn’t they already do this kind of thing in GM1?? When account books show RM67m BNM only find RM20M.??

Letter to Editor, Star, 19-10-12

Just what kind of gold investment is this?

I REFER to “Schemes unsustainable” (The Star, Oct 11).

It was earlier reported that at RM218 per gram, a customer paid RM218,000 for 10 wafers of 100 grams of 999.9 gold.

Assuming “hibah” (goodwill/return) is at 2% per month for a six-month contract, the customer would earn a total of RM26,160 at the end of the contract period.

Now, a check at Star Biz on the same day reveals that “The price of gold as at 5pm (Oct 10) stood at RM168.55 per gram.”

A simple mathematics calculation will show that the customer is actually paying almost RM50 more for each gram of gold he/she purchases, give or take a difference of a few sen due to the different transaction days.

This means the customer has paid a total of RM50,000 more upfront for the 100 gold wafers bought.

So, doesn’t the hibah actually come from the RM50,000 paid upfront?

It looks like the scheme is “sustained” by the customers themselves. As long as the customers continue to put in and take out their own money, the “harvest” will continue to be “guaranteed”.

But, what kind of “investment” or even “trading” is this? Beats me!

A downgrade from “Yes, GM2 is ethical” to “ethical UP TILL POINT OF INVESTIGATION”. Well, my position had been consistent from day 1, which is not ethical even if acquitted. Would your position deteriorate further to match mine if GM2 is not acquitted?

And to make this investment works, the concept of ‘buy lowest, and sell highest’ must be exercise, right?         Didn’t I answered you on my post on 24/10/2012 at 09:26 and let me reiterate again: –

But buy high (20% to 30% higher than Bank) and try to sell higher (if gold appreciate in the future, though gold price had been stable for the last 1 year) is not a concept of investment, right? Sound more like a portfolio mismanagement (or scam?), rather than investment. Yes, holding gold is an inherently investment in the salient value of the gold itself, PROVIDED one buy at the lowest (from the bank, and not GM2) and sell at the highest (again, if gold appreciates). That’s my answer.

        But since you mentioned “buy GM2 with hibah in mind”, than that’s a different story. Why should one buy gold WITH HIBAH IN MIND, when GM2 didn’t say so?

        Anyway, Anon Me, be straight forward to all and can you tell us specifically: –

        Purchase gold from GM2 with Hibah of say 2% a month for 3 months is not investment, as the initial price of purchase is 20% to 30% – so, GM still sell gold of 14% to 24% higher than bank once the 3 months hibah is received. This is assuming that this discretionary hibah is paid out.

        So, purchasing gold from GM2 is not an investment as one pay high and try to sell higher, when one can purchase from an established bank at 20% to 30% lower and sell high.

        Agreed?

        By the way, where did GM2 claims it pays discretionary hibah? Didn’t it told bank negara that it is just a straight forward gold trading company? Are you confused by some other goldco that pays out ‘hibah’?

        What elaboration / clarification do you sought on my post on 20/10/2012? Why use the ‘INVEST’ word? Well, that word had been appearing everywhere from Bank Negara statements to Awang Adek statements. Heck, some of GM2 ‘investors’ also called themselves ‘investors’!

        So, I am here to seek your clarification / elaboration if GM2 is really an investment or not. Yes, I am confused like everybody else – GM2 says they are gold trader, but BNM & Awang Adek says they are investment.

        Now, back to my question which I believe you are trying to dodge.. naughty naughty 🙂

The lure of promised paybacks

If you leave the ‘loan’ with Genneva for the next 12 months, they will pay out 24 % in total back to you with an additional 12 % to the consultants who fit into the pyramid that successfully referred you to them. That totals 36 % payback for each subsequent year. If we assume the company purchases gold bullion at the prevailing market rates, they will still stand to lose 6 % for every such ‘loan’ made to them – 100 % cost of gold + 30 % mark-up – 36% interest equals -6 %.

And so the question is how or what Genneva needs to do to make up for the yearly loss of 6 %. By then their total ‘loan’ intakes had amounted to RM 3 billion, which means the interest payouts were working out to RM 180 million annually. That’s where Genneva resorted to a combination of scams going by the names of ‘Factional Scam,’ ‘Ponzi Scam’ and something as dubiously named as ‘Tai Chi Tactic.’

To elevate Genneva to the ‘big boy’ stakes, they went on a huge recruitment and exposure campaign, not only sponsoring sporting events but also bought out Datok-ship titles from Indonesia and/or Brunei, hosted lavish annual dinners, extravagant lucky draws, glittering conferences and seminars.

Once they have attained the maximum requirement amount of investment, the second stage of their plan kicked in – that’s where the real game began.

Guaranteed returns

Contrary to what others thought, Genneva smelled like a Ponzi scheme right from the beginning but unfortunately too many people were too centred on wanting to get rich and therefore dropped their guard. That’s how these things operate with impunity in this country – simply that most people don’t care until it hits them hard.

Every investor who supposedly invests in Genneva would get a 2 % guaranteed return per month in the form of “Hibah” or “Gift” for the next three months. This was the preferred terminology because calling it ‘interest’ or any such equivalent was deemed illegal.

This investment is considered a ‘loan’ to Genneva where they then provide you with partial collateral using gold and an interest rate of 2 % per month.

The consultant who successfully recommends Genneva to anyone gets 0.6 % per month of the ‘loan’ amount or even more, depending on the tier he is at – whereupon all consultants are placed in some form of pyramid-like commission structure similar to schemes pioneered by Amway.

Beginning at 0.6 % per month, it also includes another 0.2 % for the ‘Senior Consultant’ and a further 0.2 % for the ‘Group Leader,’ totalling 1 % as the overriding commission for the ‘loan’ they manage to attain for the company.

Firstly Genneva would utilise the ‘loan’ to purchase gold bullion, which is cast with their name and then certified by an NGO (such as Gold Bullion Association of Malaysia) to signify that they – and not the investor – had actually established themselves.

For this, no one knows the actual purity of the gold you will receive unless you decide to melt the entire bullion and analyse it.

Even so, the collateral given to you is never in full; the snag being that in order to participate in Genneva’s scheme, you the investor must then purchase the gold bullion at 30 % higher than the market price.

Latest news by BNM on tv news earlier.

More than 1700 out of 4000 names of consultants of the 3 gold companies are also bank staffs,unit trust and insurance agents registered / licensed under BNM, MIAA may face termination for lack of professionalism and contradicting BNM / MIAA’s code of conduct by getting involved with companies involving non-legitimate / illegal schemes including gold, land banking, live stocks and non legalised forex.

A spokesman said on camera that the authorities will not tolarate to take actions against misconduct on representing “skim tidak sah” while carrying the status of professional unit trusts and insurance representatives and some as bank employees representing financial institutions covered by BNM. He also mentioned BNM will keep a stream line on those representing other non recognised portfolios by BNM while still carrying status as a financial institution representative.

Info on the databases are from seized files from the 3 goldcos.

2. ABC Company later supplies the gold to GM with 20% profit at spot price.

3. GM then sells the gold to their clients at a 25% above spot price.

Could ABC Company be a subsidiary of GM?

Could ABC Company be a proxy for those who have interest in GM?

Orders have also been issued to the directors and key personnel of the companies concerned to declare their assets in Malaysia and overseas, including those of their spouses and proxies.

These investigations have been accorded priority and all the necessary resources are being mobilised by the relevant enforcement agencies to expedite this process. This is to bring this investigation to the earliest conclusion.

Possibility 1, the finance minister and his party needs funds desperately, what better way to source for immediate funds than a cookie jar he is pretty much familiar with?

Possibility 2, the ex-chairman of Genneva has teamed up with a competitor, he knows when and how to strike on them, just to get back at them and also benefiting his company now where you never know it may have a sharing basis between him and BNM, 100-200 kgs of gold is really a lot, I mean really a lot.

16 Oct 2012, Sg Finance Minister Tharman issued a written statement in Parliament relating to the raid on Genneva on 1 Oct:

[SINGAPORE] Gold buyback schemes are currently unregulated, but the Monetary Authority of Singapore (MAS) will continue to monitor market practices and refine its regulatory framework if necessary, Deputy Prime Minister Tharman Shanmugaratnam said yesterday.

In a written reply to a parliamentary question that comes after this month’s raid on the offices of gold trading company Genneva Pte Ltd by the Commercial Affairs Department (CAD), Mr Tharman, who is also Finance Minister and MAS chairman, added that running a fraudulent or deceptive scheme is an offence under the law regardless.

“Like most other financial regulators around the world, MAS does not regulate schemes that involve investors acquiring direct ownership of physical assets, such as property, gold, art or wine,” said Mr Tharman.

However, it will continue to monitor market practices and investment landscape trends, and refine the regulatory framework where necessary, he said.

Mr Tharman urged investors to consider how returns in any scheme are generated and find out whether there is any protection or recourse should the operator fail.

Now the difference in view between BNM/AG Chambers and Genneva boils down to whether the scheme is unsustainable (ponzi) or sustainable it can be resolved if both sides were to sit down, if necessary with an impartial professional moderator such as one of the accountancy bodies such as ACCA, and open their cards. For GMSB, please do not sent your director joseph kow as he had already told BNM that he doesn’t know the mechanism of the scheme.
Why keep on the “argument of the deaf” and try scoring point while letting the customers suffer?
Why try going for a “political” solution and wait for desparate customers to commit suicide?
Why is the Genneva supporter club not going for a resolution of the problem as an aftermath of the raid since BNM/AG chambers had pointed out its concerns in its preliminary finding? WHY, WHY, WHY?

As a follow up to the law suit against Genneva Gold Trading Firm in Singapore in Sept 2012, the firm finally gets raided by the authorities.

In a rare show of joint action, both Bank Negara, Malaysian police and Singapore Commercial Affairs Department raided Genneva offices in both Singapore and Malaysia.

According to Business Times, the management discovered “some financial improprieties” which led to the delay of payment of commissions and discounts. Apparently the company directors filed police reports as well.

Apparently 3 of the directors – Ng Poh Weng, Marcus Yee Yuen Seng, and Chin Wai Leong are already being sued by Bank Negara for alleged illegal deposit taking and alleged offences under anti-money laundering laws, one just wonders how they can fly under the radar for so long in Singapore.

The even more ridiculous part is that the directors previously operated under Genneva Sdn Bhd, and because it is under investigation and frozen by Bank Negara, guess what? They set up another company called Genneva Malaysia Sdn Bhd and continued running the same business.

It sounded like they are already making the same transition in Singapore by asking current clients to move their “gold assets” from Genneva Pte Ltd to another company called Genneva World Pte Ltd. So there again, running through legal loopholes, the regulators better do something about it this time or they just open up company after company.

On 1 October 2012, joint raids were carried out on several premises of Genneva Malaysia Sdn Bhd as well as on the residences of the Directors of the company by the Royal Malaysian Police, Bank Negara Malaysia, Ministry of Domestic Trade, Cooperatives and Consumerism and the Companies Commission of Malaysia.

Genneva Malaysia Sdn Bhd and its related companies are being investigated by the relevant enforcement agencies for suspected offences which include illegal deposit taking, money laundering, tax evasion and avoidance, false description including misrepresentations, appointment of agents without licence and failure to lodge statutory documents.

Relevant assets and documents of the companies seized from the raid will be preserved for the purpose of facilitating the investigations. The relevant enforcement agencies have mobilised the necessary resources to expedite the investigations.

This is the 18th page. Just a summary of the Genneva saga for the benefit of new readers:

History of Genneva Gold raided by the authorities on 1st Oct 2012.

2007 Start business with Genneva Sdn. Bhd. (GM1)

June 2009 : launched Samudra Sdn. Bhd. (GM2)

21/07/2009 : Raided by BNM same time as EtikaMas. Operated a “Parked -in” scheme whereby the customers paid for and park the gold with the goldco. At time of raid as reported by STAR, the company’s frozen account has RM20 million plus 5 kg gold. The goldco had collected “parked – in” fund in excess of RM67 million.

September 2009 : Samudra Sdn. Bhd. (GM2)started operation;

15/12/2010 : Launched the Syariah program under Genneva Malaysia Sdn. Bhd. (Ex Dimensi Sentosa)

April/May 2011 : All SGV accounts were compulsorily transferred to GMSB;

December 2011 : Gold prices fell drastically;

Early 2012 : goldco’s Sg branch stopped paying consultants’ commission;

Mid 2012 : goldco Sg run the SKR (Safekeeping Receipt) scheme paying 4.5% discount but without gold (similar to G1 Parked in scheme) netting nearly S$50 million. Quietly launched Genneva World.

hahahaha, how many stupid qns Anon Me wants to ask?

I am not MAS, CAD, BNM, or Attorney Chambers trying to charge GM2 or some Tak-Jadi Lawyer trying to defend GM2, why should I produce any papers etc whatever for the CON-Sultants? I am nothing to do with GM2.

You Anon Me, on the other hand, are showing signs of stress and frustration having to prepare your defence of your GM2 bosses of looming crimnal and civil suits. In the midst of defending GM2 in cyberworld, you need to face real world now. No need to show your anger here, ok?

hahaha, another stupid question from Anon Me. I am repeating AGAIN – I am QUOTING your GM2 bosses publicly available information on their website. I did not issue the statement. Whether I know or not before hand, so what? I dun work for GM2, I have nothing to do with it.

So everyone, this is GM2’s bosses position to their CON-sultants now:

CONsultants: “We SINK OR SWIM with Genneva”

Genneva: “WE SWIM. You sink!”

Consultants – your bosses have abandoned you now. Hope you have a life-buoy to rescue yourselve !

    1. How did you know buyback is not guaranteed & that hibah is discretionary? Prior to GM2′s statement on 15 Oct 2012, you did not know?

    2. Can you direct us to some verbal or written evidence of consultants promising otherwise?

    3. Eternal sunshine holidays for directors – Are the directors who are currently charged in court from original Genneva on holidays now? Pls name just one director on sunshine holiday now. Will BNM ongoing investigations make it easier or difficult to go on sunshine holiday?

A simple YES or NO is only required.
